STATEMENT FROM CHICAGO MATHEMATICS & SCIENCE ACADEMY
Regarding the Representation Petition Filed by the Chicago Alliance of Charter Teachers & Staff

   In June 2010, the Chicago Alliance of Charter Teachers & Staff filed a representation petition with the Illinois Educational Labor Relations Board, seeking to represent a group of Chicago Mathematics & Science Academy (CMSA) teachers and counselors for collective bargaining purposes.  That petition is still being processed by the state agency, and nothing has been finalized in terms of designating the Union as the official bargaining representative for CMSA’s employees. 

   After studying the Union’s representation petition, as well as the various federal and state laws that potentially apply to a private not-for-profit corporation like CMSA, CMSA believes that it must comply with federal labor law as administered by the National Labor Relations Board (NLRB).  As best as CMSA can tell, federal law governs any attempt by states (like Illinois) to regulate labor relations between private corporations and unions.

   In order to help clarify this situation for all involved, CMSA filed its own petition with the NLRB on Thursday July 29, 2010, asking for its help in resolving whether the Union in question should become the bargaining representative for CMSA’s teachers and counselors.  A hearing is currently scheduled for August 12, 2010, at which time the NLRB will accept evidence and legal arguments regarding its jurisdiction over CMSA.  The NLRB is expected to issue a decision soon thereafter.

   Throughout this process, CMSA’s top priority has always been, and will always be, its students.  CMSA remains committed to providing a high quality, college preparatory learning experience for its students, and will continue to do so in conjunction with its teaching staff (and any Union representative that its teachers may decide to select).

Regarding CMSA’s Non-Renewal of Teachers’ Employment Contracts

Toward the end of the 2009-10 school year, CMSA decided to cancel and/or not to renew a number of teachers contracts for the upcoming school year due to budgetary concerns.  One of those teachers was Rhonda Hartwell.  CMSA strenuously denies that it decided not to renew Ms. Hartwell’s employment contract based on any alleged union organizing activity in which she might have engaged.

Dear Parent:
I am writing on behalf of the Chicago Mathematics & Science Academy (“CMSA”) to provide you with information regarding recent union efforts to organize CMSA teachers and staff. 

You may have received communications from some third party individuals about this union organizing effort.  I would like to take this opportunity to clarify any misconceptions that parents may have about this process.

A union by the name of the “Chicago Alliance of Charter Teachers & Staff, IFT, AFT, AFL-CIO,” has recently filed a representation petition with a state agency called the Illinois Educational Labor Relations Board.  The union is seeking to represent a group of full and part-time teachers, counselors and social workers at CMSA without the benefit of a secret ballot election.  CMSA is currently evaluating the representation petition and considering what, if any, response it will make.  CMSA wishes to clarify, however, that the union has not yet been certified as the exclusive bargaining representative of CMSA’s teachers and staff.  Rather, a prolonged investigation period still needs to be conducted by the Illinois Educational Labor Relations Board.  According to the agency, one reason for such an investigation is to ensure that the union has not solicited support from employees through fraud or coercion.
It is our understanding that individuals may have recently called some parents about this organizing effort, and actually invited parents to some type of union meeting.  Please be advised that these calls and/or meeting(s) were not sponsored or otherwise authorized by CMSA.

CMSA will keep you updated about its position regarding the pending union representation petition.  As mentioned above, CMSA is still in the process of reviewing the union petition and considering options for responding to it.  We anticipate sending you a follow-up letter in the next several weeks that further describes CMSA’s position.

Les estoy escribiendo en parte de Chicago Mathematics & Science Academy (CMSA) para informales de las recientes actividades de los maestros en nuestra escuela CMSA. 

Los maestros y trabajadores estan en proceso de formar una unión. Ustedes talvez han recibido información sobre éste tema por personas de tercera mano. Me gustaría tomar la oportunidad de clarificar cualquier confusión que tegan sobre el proceso en mano.

    Una  unión con el nombre de,  “Chicago Alliance of Charter Teacher & Staff, IFT, AFT, AFL-CIO,” han aplicado para representar el grupo de maestros, consejales y trabajadores sociales de CMSA con una agencia estatal  llamada Illinios Educational Labor Relations Board sin el beneficio de una elección de boleto secreto.  CMSA esta evaluando la petición sobre la representación y conciderando si habrá cualquier clase de respuesta.  CMSA quiere aclarar que éste grupo que aplicó para representar a  nuestros empleados no se ha establecido fijamente. Todavía esta una investigación con la agencia estal, Illinios Educational Labor Relations Board.  Una de las razones es, por cual la agencia quiere investigar que no sea un fraude que solicita a nuestros empleados.

Tenemos entendido que algunos individuals han llamado a los padres de estuiantes para invitarlos a juntas de la unión.  Por favor sean avertidos que esas juntos no son autorizadas por CMSA y no tenemos participación en esas juntas.
CMSA los tendra al tanto de la unión pendiente y la representación de los empleados de CMSA.  Como he mensionado todavia estamos en tránmites de resolver la petición de representación de nuestros empleados y las opciones que vienen con ellas. Anticipamos mandar otra carta sobre éste tema en las semanas que vienen con mas detalle sobre las decisiones de CMSA.
